My question involves personal property located in the State of: Maryland
I am a renter in the state of Maryland. I have rescued 3 strays from death (2 cats in the middle of winter and they were close to death and 1 dog whose siblings we found homes for - before finding out the original owner had killed their mother through starvation and neglect) and also a another dog I paid for. So I have these animals out of the kindness of my heart and then of course grew to love them and couldn't part with them. The offending feline is a VERY affectionate and loving, completely non-aggressive un-neutered male. He got out of the house and according to my neighbor (see post in restraining orders for the rest of the juicy drama) chased and bit her 8 year old boy. I have no proof other than their testimony that this is what happened... but I find it highly unlikely that a CAT chased a boy and bit him. This is the sort of cat that will sit there and nudge your hand for hours begging to be pet constantly or who loves to fall asleep in your arms like a baby. Anyway, I got him back from animal control and since none of my animals have their rabies vaccination (didn't know they had expired) he had to be quarantined for 10 days. I had him on a harness leash at all times unless he was in the crate. When I left the house, my sister let him off the leash and go figure, he got back out. My neighbor then claims he charged at her but didn't hurt her and animal control was called again. He's now sitting in a crate at the humane society and I have to pay hundreds to get him out. I've already vaccinated my 3 other animals and am making plans to have them all neutered.
Couple of questions. 1. I'm not the one who let the animal off the leash and I gave DETAILED instructions to my sister to NOT let him off the leash or out of the cage. I literally yelled at her because she argued with me so there was NO doubt that she understood. I'm not the one who let the cat off the leash so can she use the fact that he got out a second time against me? I did everything in my ability to keep him contained but I can't stay in the house at all times!
2. The cat was unofficially both of ours (though after all of this, I registered him to me but at the time he was both of ours) so how is it right that she sues me? The apartment is in my sister's name (though i pay all the bills) so again, how is it that she is suing me? If it turns out that she is suing the wrong person, is there a possibility that the case will be denied and she will have to pay the legal fees? That would be ideal... what's ironic is that I would've paid out of court without hesitation. She's taking me to court and ruining my life? I will fight.
This woman is trying to file an unfounded restraining order against me (again, see my post in restraining orders) and she tried to get me evicted (realtor said I'm fine whew) and she's suing me for money I don't have! I was unemployed for THREE months, am behind on everything but the rent and only got a job a week ago! I'm nauseous all the time, can't sleep for the past week, panic attacks constantly ... ugh. I'll be telling this all to a lawyer but I respect the opinions of everyone on this site immensely. I'd like to hear some opinions and explanation of what will happen. I'm terrified, I've never been sued before ... hell, I'm not even used to people not liking me. I do my best to be kind to everyone but I have a limit!:wallbang:
