My question involves labor and employment law for the state of: Georgia
I have been on short-term disability for around 4 months now and will be going back to work within a few weeks. I have a very physical job that I will no longer be able to perform. My doctor even told me that if I go back to doing what I was, I will end up injuring my back even worse. I am supposed to take a functional capacity evaluation test before I go back so that it will show what I can and can't do. My question is this: does my employer have to accommodate my restrictions? I will probably be on permanent light duty and I don't know if they have to let me come back or if they can give me another job in the company or if they can just fire me. I've read that Georgia is an at will state so I'm guessing I can just be fired, that they don't have to accommodate my light duty. I plan on setting up a meeting with my boss before I go back so I will know what their plans are but I was wondering if anyone else had been in this position.
There are so many physically demanding jobs out there and by the time a person gets close to 50, their body is basically worn out. It's frustrating knowing that I will probably have to look for a new job, one that is sedentary that I don't have much training for and probably won't be able to find one making the same money and benefits I've had.
