Establishing Paternity: Establishing Paternity and Getting Child Support After Age 18

mardi 7 octobre 2014

My question involves child support in the State of: I live in South Carolina, 18 year old child lives in Wisconsin and mother lives in North Dakota.

I may be the father of a 19 year old but paterntiy was never established, I am not on the birth certificate, I never signed anything stating I was the father, nor was a court order set in place to pay child support. At one point when the child was 5 I voluntarily gave the mother money but as soon as I said I wanted to establish paternity and get my rights if I am the father, she went off of the radar and I stopped making the voluntary. After all these years I finally found the mother and told her that I want to have a DNA test done. She and her daughter both have agreed to the DNA test. The daughter was born in Nevada, but for the last few years she and her mother have lived in North Dakota. Now, she has gone off to college and lives in Wisconsin. My question is, since paternity was never established and there was never a court order to pay child support, can the mother take me to court for back child support if paternity test confirms I am the father? Thank you very much for any advice you can provide.
