Modification of Support: Response to Order to Show Cause Modification or Child Support

vendredi 3 octobre 2014

My question involves child support in the State of: California

My Ex-wife just served me with a Modification to Custody Order requesting for Child Support. I know I am suppose to respond & I have all the forms & documents for Responding. At the moment the Ex-wife has custody of our 5 year old son, but because of some new information I have been getting from the Ex-wife's family about her treatment & neglect behind closed doors, I want to try & get full custody.

My question is: when or what should I do first? Do I file a Modification to the Current Custody papers? Or should I wait until after this up-coming court hearing for Child Support that I have just been served? I felt like this up-coming court hearing would be a best time than ever to try & modify the current Custody Orders, would save me a whole lot of problems if I could. And if I could do a Modification, what should I do first?

Thank you for your time.
