Adoption of Children: Can My Husband Adopt My Child if the Father is Listed As Unknown

lundi 1 décembre 2014

My question involves adoption law for the State of: New Jersey

My husband wants to adopt my child. The father is listed as unknown (one night stand). We both have different concerns.

His concern: if he adopts my child, and somehow we see the biological father one day, will my husband potentially lose rights to the child? Does it depend on how long the child has been alive/adopted for?

Also, is there a way to terminate the rights of the birth father if he is:

1. not listed on the birth certificate (it is listed as unknown)

Would it be easier to do the adoption before, or after, the termination of parental rights for the unknown father?

Is it hard in NJ to terminate the unknown fathers rights? What is the process?

Any answers to these questions would be VERY helpful.
