Determination of Fault: Swiped by Driver Driving in Left Turn Lane

My question involves a traffic accident in the State of: Michigan



My brother was in an accident today and he got a ticket for "failing to yield". We would like to fight it, and I want to know what you guys think of this. So here is how it went:



My brother was on a 5 lane highway, 2 lanes going in either direction, and 1 turn lane. He was in the left travel lane (not the far right), because he needed to turn left at the intersection. He was about 10 cars behind at a intersection that had a red light, everybody was stopped. He wanted to get in the left turn lane to turn left at the intersection. He turned his turn signal on, merged out of the left lane into the TURN lane, and was swiped in the front left corner by a vehicle traveling approx. 15 MPH in the turn lane to get to the front of the intersection. He HAD his turn signal on, and the women who hit him merged into the left lane very early, crossing a solid yellow line (he was crossing a solid yellow line as well to get into the lane). He did NOT see her when he merged. She swiped him and then kept going, proceeded to the light at the intersection, he pulled up behind her, and they pulled into a parking lot after turning left.
