Divorce: I Filed Petition for Divorce and Wife Filed Application for Temporary Orders

lundi 8 décembre 2014

My question involves a marriage in the state of: Oklahoma, Cleveland County

My wife filed an application for temporary orders asking for alimony, attorney's fees, and more access to the marital home. The judge ruled that no alimony would be granted due to the length of our marraige (2 1/2 years). He also granted my motion to amend my petition to include attorneys fees and litigation costs.

My question is: Will I have to file a Motion to Modify Temporary Orders or file my own application for temporary orders to ask for my personal property like VA disability income to be returned?

We had agreed to a no contest divorce in May of this year (2014). However, when it came time for filing she emptied both my checking and savings account, 90% of my income is military retirement effective date: 2007) and VA disability benefits (award date 2008).

As I do not have income to hire an attorney, I've got back to law school to get myself this far.

So my question is: do I have to file a motion to modify temporary orders (even though I didn't file with my petition) OR file a motion to modify temporary orders and ask for the return of my personal possession?

Thanks!
