My question involves a traffic ticket from the state of: California
On 9/10/2014, I was pulled over on Highway 29 near Clearlake, CA in Lake County. The speed limit is 55 and I was clocked at 83. (I didn't realize the speed limit was 55... I thought it was 65 or 70. But still speeding, I know.) I live in Honolulu, and was in California on business, so I was driving a rental car at the time.
My arraignment date was 11/18/2014, and I called the court a few days before to request a court date in January since I will be back in the area. The clerk agreed and gave me a court date of 1/20/2015. I received a notice from the court confirming that date, so I booked plane tickets (I need to be back in CA in late January anyway so it worked out.)
But just a couple days ago, the court sent me another notice telling me the court date was changed. The new date is 2/3/2015. I won't be in town that date so now I have a major problem. Do I have any kind of defense with regard to a speedy trial?
Additionally, the license plate listed for the car I was driving was incorrectly recorded on the ticket. My rental car had California plates, but the officer listed the car as having Hawaii plates (right number, wrong state). Might the court throw out the ticket on that basis?
