My question involves criminal law for the state of: Washington
My friend was walking down the road, when a police officer stopped and asked if a warrant had been taking care of, unaware of any, he replied "what warrant?", the police officer placed handcuffs on him placed his shopping bag in the trunk of his patrol car and drove him down to the station.
At the station while running my friends name,
The officer then walked him into a room, grabbed the shopping bag took into another room where he said he had found a large amount of methamphetamine, along with toiletries. My friend replied with,"where did you get that, well its not mine."
then it was confirmed that he had a warrant, my friend NEVER once was even aware of any incident even taking place to have a warrant for animal cruelty.
my friend was charged with a VUCSA, my friend had $1100.86 in pocket (just sold car), when bailed a check for $0.86 was returned, claiming it was drug money,
my friend said if that was the case shouldn't all of the money been taken.
COULD A MOTION TO BE SURPRESS BE FILED DUE TO VIOLATING THE FOURTH AMENDMENT AND FRUIT OF A POISONOUS TREE,SCOPE, PLAIN VIEW DOCTRINE?
