Hearings and Trials: Filed Motion to Suppress, What to Expect in Court

mardi 9 décembre 2014

My question involves traffic court in the State of California.

Alright, so I got a ticket, sent a discovery request to the DA which they never responded to. I filed a motion to suppress evidence with the court and DA, and I have a motion hearing tomorrow. I really don't know what to expect, do I just hand my paperwork over or do I have to state my case (or both)? This is a trial by written declaration, so this isn't the actual trial, just a motion hearing right? So afterwards I still have to submit my written declaration paperwork, right?

I did all this before and won my case, but they didn't require me to go in front of a judge. I'm guessing they didn't file my paperwork properly or were just lazy? I feel a bit in over my head, I didn't know I was going to have to show up and see a judge since it didn't happen last time. I don't know, I feel flustered. What should I expect?
