Seeking Litigation Attorney who can consult with our San Diego based Patent Attorney, then quickly & efficiently file a declaratory relief action at a reasonable cost.
I am a Utility Patent holder in San Diego and LLC business owner (licensed in Phoenix). I'm seeking a Litigation attorney licensed in CA (or AZ), versed in Patent law, who can quickly & inexpensively file a Declaratory Relief action to force venue to our turf (San Diego or Phoenix) against a represented patent holder based in Florida who has mailed us a letter alleging our product infringes on their Patent. In fact we have our own Utility patent and we are not infringing. The other party's Patent expires soon and was cited in our issued US Patent. We seek to file a Declaratory Relief asap as the other party has not filed any suit yet, thus making it unreasonably expensive for the other party to go any further with this frivolous harassment. Who can help?
Thus far I have consulted with my Patent Attorney who recommended this declaratory relief action. Additionally, I've consulted with a San Diego based Litigation Attorney who also recommended the declaratory relief, and an additional law suit. I've decided not to retain this litigation attorney feeling he was overly confrontational, expensive and inefficient.
We view this as a simple matter that, best case, will go away by imposing venue and inhibitory costs in San Diego (possibly Phoenix) on the other Florida based party. Worst case, litigation would be on our home turf.
