Copyright Law: Website Design, Logo, Content, and Domain Name Copied. What Can Be Done

Hello,



I discovered a website that is nearly an exact copy of my company's main money making website. They copied the design, logo, content, and the domain name is the same with the addition of "ed." In the content, they have switched the site name to their name with the "ed" but I found a spot it was missed. The logo is unedited and has the website name on it. I did file a copyright for the website in early 2012, but then later found from my former lawyer they wanted more info. He didn't inform me of this, so the filing was never completed. I do have the copyright notice on the site, though.



On the copy of my Website, there is a "designed by (company name)" listed. The company is based in Delhi, India. The owner of the site appears to be in UK (not verified that yet), but it appears this company was hired to copy my site. So they got paid to infringe on the site design, content, and logo.



Me and my company are based in the United States.



I have sent a DMCA to the host provider. So the site should be taken down.



At this stage, we can't prove any monetary loss, but we pride ourselves on giving good customer support, and if this site does not, it's possible we could have negative reviews posted referencing my site's name.



My biggest question is; Can I take legal action action against the design company and / or the owner of the site? What kind of monetary judgment could be won? I realize being in different countries and not having the copyright filing completed could make it not worth my time.
