Use and Enforcement: My Rights of the Easement in Tenn

samedi 20 décembre 2014

My question involves an easement in the state of: Tenn my home is landlocked and I have to drive through my neighbors property to get to my home. My house was here first, and when my neighbor bought his property, the original owner of my house bought the easement rights for $1... It is a 30' ingress/egress easement starting from the edge of the property... you come off the main road, turn into the drive and come down about 200' before you get to my property line... I've just gone through a nasty court dispute over a 43 sf corner that I've been driving over for 18 yrs, the neighbor put up a fence so I could no longer drive over this... its very difficult to get out of my driveway now... what I want to know is this: about 10' of the easement spills into his yard (grass) all the up the driveway (easement).. can I use all 30' of the easement? can I plant bushes all the up the drive? can I dig a ditch along the sides of it? can I plow the entire thing up? what can I do and not do to this 200' x 30' easement?
