My question is on fighting this ticket in California. I have a clean dmv record and no arrests. It was 6:30am and very few cars on the city streets. I went to make a right hand turn from a dead stop while driving my fathers Dodge Ram turbo deisel pickup. The road conditions were fair, cloudy, cold, a very slight moisture in the air and on the roads but far from being considered wet. As i went to make a right from a dead stop onto a major 3 lane street, the lane i am legally turning into immedietly has to merge down to 2 lanes and the speed limit is 40 mph. I make the turn and as im straightening the truck out and begin to look into my sidr mirror to make sure im clear to merge i notice another vehicle approaching from the next lane over but yet far enough back that its still safe to go into their lane. So i signal and begin to change lanes at a speed of maybe 5 to 10 mph max at this point and begin to accelerate even more knowing there is car coming from behind me already in that lane. Now considering i have driven my dads truck only a few times prior, the power in that truck is incredible and what would have been okay in my honda accord apparently wasnt in his truck. The rear tires broke loose and began to burn out. I immedietly let off the gas and waited for them to grab again before i accelerated again and at this time i gassed it a little more to avoid the car approaching me to have to slow down. I never got side ways at all, never was i a threat to anyone around me, nor did i cut anyone off and never once did i go over 40mph. The officer claimed he heard the tires burn out and so he pulled me over.
This is when things got worse. He ran my license and it came back as expired one month prior on my birthday and i completely forgot all about and never got a letter from the dmv about it..Which dont get me wrong i know its my responsibility. So he took me out of the car and searched me and sat me in the back of his car and gave me the option to either walk home a mile away and impound the truck or call someone to come get the truck and drive it home. Obviously i called someone and had them take me to the dmv immedietly and payed to renew it.
He sited me for expired license and cvc code 22350 / speed law was written on the ticket. Not for burning out for a split second. Someone pissed in wheaties obviously prior to pulling me over. I was polite the entire time, he was being nice himself and i know he could have arrested me and impounded the truck but was nice enough to let me go. So i should be thankful. But im not. I cant believe the guy acted like im so young teenager and smoked the tires off the truck... Im 39 yrs old, it was 630am in the morning and half asleep when i picked up the truck from my parents house since my cars starter failed the night before. I needed to take my 2 kids to school that morning. So my question is how can i fight this ticket...i know the license part can be signed off, but the cvc22350 cant be obviously. The officer didnt write down any speed on the ticket or anything to do with speeding. No radar, etc... He just heard the tires burn out for second. Any ideas what might convince the judge of this that would get that part thrown out in court?
