Eviction Notices: Dispute with 3 Day Pay or Quit

My question involves an eviction in the state of: CA



Basic info.: I rent a room in a townhouse owned by a mother/son pair. Son lives in the home. I've been here since May 2013. The lease is every three months and continuous. I do get $50 a month credit towards the $550/mo. rent, which includes utilities.



November 25, I was given a notice to pay $410 by January 1 or have to move out. I paid $590 in three payments between then and January 1, so the demand fulfilled and then some.



Yesterday, the mother served a 3 day notice to pay rent or quit. It is calling for $820 when rent owed is only $320 according to a rent sheet and the three payments totaling $590. I do not know where she gets the figures listed on the notice for rent due.



I cannot show for the $590...only have the son's word, because he is the one I gave that money too...all 3 payments. November 25 was the last time anything was written on the rent sheet. She wrote the notice of paying $410 on the rent sheet, so I kept that as documentation of the notice.



I did provide copies of the 3 day notice and the rent sheet to her son and still waiting for a response, but what can I do to legally challenge the notice if it gets that far? This could be as soon as Monday.



Does a 3 day notice to pay rent or quit count weekends? This was served yesterday...a Friday after closure of the courthouse. It does not open again until Monday.



Other disputes involve the lack of a mail key...never had one here and locking utilities (air/heat). Can I lawfully use these against her in argument?
