I have a 5 yr old daughter with my ex and since we separated in 2011 we had papers drawn up specifying who gets which holiday and so on . It also states that the non custodial parent gets to file her on his taxes every other year . This year would be his year according to the papers , but he has not paid child support since April 2014 and she does not stay with him half of the year . We've been going back and forth about who should be the one the claim her this year . Him , even though his lawyer said he must be up to date on child support by the first of the year in order to claim her or Me , the one who has supported her all year and who she lives with for more than half the year . I know the papers say him , but technically she doesn't even qualify as his dependent this year . And his lawyer did say that he had to be up to date , but never put it in writing . I want to know if I should just go ahead and file her .... or let him do it even though he hasn't Supported her this year .
