My question involves labor and employment law for the state of: Virginia
I am female in a male dominated uniformed agency. On weekends we are allowed business casual dress with restrictions. Last year I wore non-running Skechers to work and was sent home to change. Now I just wear the uniform. Last Sunday I was in uniform but had a non-uniform jacket on because it was cold. I was told I could not wear it. I asked management why they single me out regarding dress code, sending me home, my hair is not correct etc.... I was the only person sent home and I have been the only person talked to about other clothing things like my coat. There are plenty of other workers including management who do not comply with the casual business dress code, for example cargo pants are not allowed, shirts must be collared and tucked in and business style shoes are supposed to be worn. I feel I was singled out and am constantly picked on about something. It doesn't matter what it is. They are bullies. I have been keep notes for 16 months on other violators who don't comply with dress code, mostly of men and some women. There are about 5 to 6 women on my shift. We are not allowed to wear jeans, sandals or flip flops but management is "allowed". "Do as I say, not as I do."
It's been a week since the last coat incident and now the one manager doesn't speak to me at all. It's a hostile work environment. I am on a special team and am not allowed to work some of the targets, for no reason. I am one of the few employees with the highest agency seniority (12 years). I have not used sick leave in over 2 years.
I have read a few things where my situation possibly does not qualify as discriminatory because if it happened to someone else, "would they think it offensive?"
And I did complain about the coat because if I have my jacket/coat on, on a Sunday when it is business casual and there is no heat and I am cold, who cares??? No where is it written in black and white that I cannot wear a non uniform jacket on a weekend when I am in uniform. However, all the other clothing violations of cargo pants, jeans, flip flops, etc are specifically stated in black and white, they are not allowed.
I think I might be able to file an EEO. Would it be worth it?
