Trade-Ins: Sued by a Dealership for Accident Damage to a Trade-In Vehicle

mercredi 21 janvier 2015

My question involves a consumer law issue in the State of: tn

I traded in my damaged car for a new car. I was in an auto accident. The dealership took ownership of my wrecked car without knowing anything about the auto claim, they did not know who was at fault for the accident or anything. In the sale of the car, I signed nothing stating anything about fixing the damaged (traded in car) once the insurance paid for damages. Now the dealership is taking me to court stating I have to pay for the damages they fixed after taking ownership of my car as the trade in. The insurance company did send me a check for damages but I already traded in my car, the dealership took the trade in as is. Do I truly owe the dealership the money the at fault insurance company paid?
