My question involves a traffic ticket from the state of: CA
I was cited for toll lane evasion. I am the owner of the car cited and a resident of WA state. My son goes to a CA university. While he was at home in WA state during Xmas holiday 2014, someone at his dorm took the car keys and drove my car without permission. No idea where they travelled. He is required to leave the keys at the dorm if he is travelling in case of an emergency. The car was just driven down there in November 2014. He graduates is May 2015.
According the FastTrak form (which is poor at best) which I received in the mail, I am responsible for the infraction unless the car was sold, rented/leased or stolen; that I must report the theft. How could I, when I did not know it was gone until now?
Not sure I would report a theft for a $29 ticket.
However, I plan to "contest" the ticket regardless of the fee because it's the principle that: I cannot be responsible for something I did not plan, participate in, or know about.
I will send an affidavit (my own) stating that all family members were out of the state of CA on the date of the infraction and the area and that car was supposed to be parked the entire time he was out of the state of CA. That no person pother than my Son is allowed to use the vehicle at any time except in an bonafide emergency or if my son is present in the vehicle.
Do I need to name my son, his university, or dorm? I believe the less information the better. Do I need to help them with their investigation as a matter "of law". Can you give me some clues to as to my defense.
