My question involves a traffic accident in the State of: New York
I was traveling west bond on Kissena Blvd (Single Lane) toward the end of the road where all vehicle must merge onto main street north bond (Double Lane) by making a right turn. Red traffic light at the intersection with the Geico insured car in front of me. Because of bumper to bumper congestion on main street, when our traffic light turn green there was a car blocking on the right lane of main street preventing the Geico insured car from going forward but it was slowly moving. As the car moving forward Geico Insured car would follow which again was on the right lane of main street. Because Geico insured car was landing on the right lane waiting continuously for traffic to move when my right of way opened up on the left, I decided to make my right turn onto the left lane of main street. As my car almost completed the turn I heard a bang on the rear, I stopped immediately to investigate and saw the Geico insured car hit my rear passenger door to rear panel and bumper with his front bumper left corner.
I have aftermath pictures plus dash camera recorded the entire incident. The Geico insured driver made a rapid left turn trying to cut onto the left lane on main street without looking. Giving the impact location on my car starting from rear passenger door, it is indisputable fact my car was already halfway passed the Geico insured car with clear visibility for the driver to see when the impact occurred. Geico denied my claim because Geico driver said I had attempting to pass when I lost control striking Geico vehicle which is total lie giving the impact point my car is at the rear door side swipe to rear bumper and his is on the tip of front bumper, how can my car move complete sideway to hit his car? My dash cam recording can show my car no way lost control or being reckless. The damage to my car is $3,447 holy cow and I don't have comprehensive insurance, can someone tell me if I have a chance in small claim court?:grumpy: please help.
