My question involves an easement in the state of:Oklahoma
My parents live on a 20 acre property that they have lived on for 20 years. While there is a road adjacent to the property, there a large gulley that would be difficult for them to build an access road across on their land.
Over the years, previous owners of the adjacent property have allowed use of a private road to allow my parents to access their property. The current owners of the property are not happy with my parents making use of this road and I believe they may be planning to deny them access by blocking the road.
My questions are:
1. Are my parents legally justified in continuing to use this road because they have done so for the last twenty years. Could a judge rule in their favor, even if the land is not technically landlocked.
2. If the road is blocked without notice, can law enforcement be called on to force the road to be reopened.
3. If necessary, can an injunction be obtained to force the property owner to allow access until the issue is resolved.
