Background Checks: Nondisclosure of Non Criminal Offense

My question involves labor and employment law for the state of:Minnesota/Wisconsin



Back in 2010, I had gotten charged with possession of paraphernalia. The way the officer charged me was slightly different than normal I imagine. I got charged with a non traffic ordinance violation, severity Forf. U. So, at least it wasn't a misdemeanor. (Wisconsin)(statute 86-17(b) if that helps)



A few weeks ago, I did some testing for a position in Minnesota, and did my interview same day. A few days later, I was emailed paperwork to fill out online, and drug testing info. completed and passed drug screen and filled out all the paperwork. On the background check, there was a question asking, "Have you ever been convicted of a crime?". being that the Wisconsin courts page specifies that this is not a crime, I decided against disclosing it.

(Possess drug paraphernalia. This is not a criminal offense and results only in a money penalty for this offense.)

Late this week, I received a denial call for the position. I'm just curious if what they did was legal or not, and if any actions should be taken. They refused to allow me to explain myself as to why it wasn't disclosed.
