Criminal Records: My Fingerprints Linked to My Sister´s Record

My question involves criminal records for the state of: California



Hello, I live in Mexico, I have an USC sister living in US. Back in 1992 I had a visitor visa, I visited her several times.

In 1998 She got divorce, she had 2 kids, she was getting welfare aid. She got a job but didn´t report the income to the welfare office.

In 1998 I arrived to US and four days after my arrival, 2 persons knocked the door, and they said my sisters name, I thought they were asking if she lived there, I nodded my head yes, she wasn´t home. I didn´t speak english. They handcuffed me because they thought I was she. I was terrified and I didn´t speak at any moment. They took me to the county jail and fingerprinted me and took my pic. After a few hours later I could call my sister and she bailed me out. After that, she showed up to the court and was convicted of a misdeamenor charge for welfare fraud. She paid the fine and did comunity service.

I returned to Mexico trying to forget the bad episode But now I´m married to an USC and he wants do the immigration process to return to US, I´m afriad because I know my fingerprints are linked to my sisters case, What can I do now? I have the court records with my sister´s bio but Im wondering if I could get the arrest report to clear up this mess.

I called the police department were I was taken but they said I wasn´t arrested by police officers so they don´t have the report. The persons who arrested me were from de Department of Public Services, I don´t know were to start to get those records.
