My question involves a child custody case from the State of: Idaho
My ex girlfriend (never married) and I have a daughter (now 5) together. We have joint custody of our daughter which amounts to a (dad)17% (mom)83% percent split of our daughters time. The little custody I have, I had to obtain through the costly court system as my ex has literally done everything she possibly can to keep me out of my daughters life. She cheated on me when our daughter was 3 months old and left me for a new guy. Her and the new guy were together off and on for the last 4 years until I just recently learned they split up. My ex has kept this information from me and has been secretly splitting her 83% custody time with him for quite some time. I realize that he has been a big part of our daughter's life and can continue to be in it if he wants to, but I feel violated that he is getting significantly more time with my daughter than I am! I have for the last few years tried working with my ex to have more custody time with our daughter and be more involved in her life while she has continued to ignore my requests for more time and to only give me my allotted time that's in the custody schedule. I have a girlfriend that I've been with for over 3 years who is an amazing stepmom to our daughter, I am a great father to our daughter, I am current and pay my child support, I have a good job and have a nice house, and our daughter loves spending time with us so there is no reason my ex shouldn't want our daughter to spend more time with me. Is she violating any of my rights as our daughter's father by denying my plea's for more custody time and splitting it with her ex boyfriend? Is this something I am able to take back to court against her?
