My question involves collection proceedings in the State of: NJ
I had a credit card that I defaulted on when I lost my job.
I could not afford the payments and I tried talking to them about a repayment plan but I was told no.
I never got served court papers but when I looked up my credit report, there was a judgement against me. I looked up my local court for the public reports, I got served and lost. Then a second hearing was held according to the report 6 months later and I'm guessing it was for a bank levy and wage garnishments.
I'm between a rock and a hard place, I can't get a well paying job because when my future employers run a credit/background check, while the background comes out squeaky clean, my credit report does not.
Because of this, I had to close my bank account in fear of it being frozen and completely wiped out.
Right now, I am nowhere near able to pay the judgement all back but I was wondering if I should contact them and talk to them to settle for a lesser amount and a repayment plan? Would that restart the SOL cycle?
According to the court documents, I owe 9K + court fees, which equaled to a little over 10 grand. I did not owe that much money.
I want to settle this judgement because the SOL in NJ for a judgement is 20 years with being able to renew. I don't want to live under a rock, I would like to have a bank account without fearing repercussions, and live an honest life.
Where do I start to settle this?
I can not afford a lawyer. And does it matter that I never got served court papers, twice?
I don't know what the second hearing was for but like I said, I'm guessing it was to levy bank accounts and wage garnishments?
Is bankruptcy my only option? Would the lawyers settle for a much lesser amount? Would the SOL restart when I contact the lawyers? How do I find out who to contact?
