I have been working graveyard hours for about 5 yrs but have been having migraines lately that have caused me to miss work. I am currently approved for intermittent FMLA. I would like to move to daytime hours. About 4 months ago a coworker that worked days quit and they offered her hours to another coworker but as of right now the switch hasn't happened. I hear they are waiting on approval to post a job opening for the graveyard shift that will be vacated. They won't let that worker move to days until they have trained their replacement. I would like to get my doctor to recommend I switch to days to help with the migraines. If I get the recommendation from my doctor would the days hours still be considered open since the other person hasn't physically moved yet or is it considered filled since they already offered it to them?
