Enforcing Custody Orders: Can You Dictate Summer Vistation Options to the Non-Custodial Parent

My question involves a child custody case from the State of: New York. Kids live with Mom full time and see Dad on every other weekend somewhat regularly.



I am trying to plan for summer 2015. My husband and I aren't officially divorced but we are in the process. I have sent a request to my ex-husband that I would like to consider one of two options for summer 2015. They are:



6 weeks in FL (2 weeks with me and 4 weeks with sitter's family who we know and done the similar thing for 2 years); 2 weeks in camp; 1 week with Dad

2 weeks in FL with me, 6 weeks in camp, 1 week with Dad



Option A costs $11,500. Option B costs $18,200. Dad isn't paying mandatory add ons for child care so I'm basically footing the bill regardless.



He has now replied that he wants to ship the kids off to his parent's in Arkansas. Both of his parents still work which would mean they would stay with family that neither I or the kids know or with babysitters that I don't know. I think he is thinking he wouldn't have to pay as much in child support for those 6 weeks which just shows me he doesn't understand child support.



I have obviously given him more than enough notice and I need to make plans for payments to cover all costs.



My question - If i reply that he can do whatever he wants for the week he has them but I am making plans for one of the options outlined, can I do that or can he stop me? As it stands now, there is no legal document stating anything except we would consult one another.
