Eviction Process: If We Evict Tenant for Nonpayment Are Sub Tenants Evicted As Well

My question involves an eviction in the state of: Arizona



We have a tenant who attempted a late partial payment which we rejected. When we went to the house to hand deliver a five day notice, there were people living in the house we didn't know, who said they were subleasing from our tenant.

Our contract does say our tenant may sublease. But we were not informed of it and don't know how long they've been there or anything.



Do we proceed with our five day notice for nonpayment against our original tenant even though he doesn't physically live there but led us to believe he did? Do we have to evict the sub tenants separately even though we have no contract with them?



Also, our contract with the original tenant states we need to give him 45 days to vacate. Does our state law take precedent over what the contract suggests and render that void, especially as he has broken the lease by not paying?
