Non-Solicitation Agreements: Non-Solicitation Clause in an Employment Contract

My question involves labor and employment law for the state of:



Hi



I work for private pest control company for over 10 years. I decided to leave next year and start my own pest control business.

My contract has got non-solicitation clause:



” Non-solicitation: You covenant with the Company in that following the termination of your employment with the Company, for a period of 12 Months you will not carry out any business similar to, or any business in connection with the Company on your own behalf or on the behalf of any other person(s), firm or Company, directly or indirectly.

This also applies to attempting to secure or obtain orders or do any business with any person, or company connected with the business.

PROVIDED that nothing in this covenant shall prohibit the seeking or procuring of orders or the doing of business not relating or similar to the business of the Company. ”



As far I know is not much the Company can do to stop me unless I don’t “steal” theirs customers so they don’t lose the profit because of my actions.



Maybe anyone had similar situation and could help with the advice.
