Speeding Tickets: Fighting a School Zone Speeding Ticket

jeudi 9 octobre 2014

My question involves a traffic ticket from the state of: California

I received a speeding ticket going 42 mph in a 25 mph school zone when the normal speed limit is 40. The time on the ticket is 2:50 PM but the officer pulled me over about 2-3 minutes after I passed the school zone so the time he said he tracked me was probably around 2:47 PM. The sign of the school zone reads "when children are present", however in the school zone there was no one around. I also checked online after for the school schedule and the elementary school there ends at 2:55 PM so children would not have been crossing the streets yet. Also, there are stop signs right outside of the school so I do not believe I was going 42 from a stop sign. I was on my way to the highway and literally right before the entrance I was pulled over.

Do you guys think I can successfully fight this, and do you guys have any advice what I can do from this point? I have not received the ticket yet and this will be my first time going to court.

Thank you all!
