My question involves real estate located in the State of: CA
I'm giving a brief history of my recent transaction that is being made and currently in progress.
Initially i have approached a realtor (X) and asked him to show few houses based on my interest. One day I met him (for the first time) and he showed me 3 different homes, out of which i felt 2 of them are near to my interest. Because somehow i felt the X is not responding or showing interest on my home search. So, on my friends referral/advice i have moved to a different realtor (Y) and I told him that i had seen a home earlier with X and i was not impressed with his work so came to you.
Y asked me if i had signed any documents with X, but none was made which i have mentioned the same to Y. After that we made an offer to one of the 2 homes which i saw through X. But the realtor X somehow came to know that i have made an offer with other realtor Y and he cunningly waited for all contingencies to be removed. Now after all contingencies cleared, before the loan closing date (i.e, in next week) my previous realtor-X sent an email to Y (involved his managers) and my self threatening (very politely) that he will proceed legally on the other realtor-Y because the home was initially showed to me by him but the offer made by different realtor-Y.
Now realtor-Y seems to be in trouble (because he offered me credit back) and X is taking the advantage of this situation. After two days of email communication X gave an offer to transfer the transaction to him in order to solve this peacefully without going legally further.
My concerns:
1) Being a buyer do i have any problem with this transaction/is there any chance i loose my 3% payment on this home ?
2) Is there a chance my other realtor-Y can simply cancel the transaction where i will loose my 3% payment ?
3) Is there a chance i loose this home ?
4) I really don't want to do my transaction with my first relator X but is there a chance that my other realtor-Y can transfer the transaction without involving me ?
5) Can i say everyone in this transaction that I don't want to transfer my current transaction to my previous realtor?
Please help me. I'm really worried now.
