My question involves criminal law for the state of: Pennsylvania
My son has an open case for attendance. This is not a truancy issue, he has a medical condition that was just recently diagnosed and is now under control. I received notice of a hearing in November, signed the green Certified Mail receipt and appeared for a hearing on 12/10/14. We were told we would receive paperwork the end of January 2015 to return for a final hearing and dismiss the case provided my son maintained good attendance and good grades, which he has. Today, 1/14/15 I was picked up by State Constables at my home on a bench warrant. The court claims that I missed a hearing scheduled 12/19/14. I did not receive notice of this hearing. I asked to see the green card, they do not have it in our file. All of the other ones are there in the file, attached to a copy of the hearing notice, but the notice for 12/19/14 has no green signature card. I did not receive notice regular mail OR certified. I therefore could not be somewhere I was unaware that I was supposed to be. I was told they don't need the green signature card, because they made the effort to inform me of the hearing. A hearing has been scheduled for 1/26/15, I was informed to come up with $125 by that date to cover the constable fees because they came and picked me up. Is this true? Do they really not need to send me notice? How can I be somewhere if I have no clue I am supposed to be there? I am not the type of person who would just not show up for a hearing. We are a good family, my son has a documented condition, he's not some bad druggie kid who refuses to go to school, he was genuinely ill. Had I received notice, even via regular mail, you bet your bottom, I would've been there! I don't have money to throw around like this. I need some help here!
