My question involves labor and employment law for the state of: Florida
I know that some agencies are exempt when it comes to not disclosing a sealed record. I have HR contacting me for an IT position at a hospital in Florida. It's not even at the hospital, but offsite at a call center. I don't know if this falls under the category of Department of Health or any other agency so my question is. If I say that this misdemeanor which wasn't a conviction, is a sealed record might come up during a background check then can they still legally deny me employment because I disclosed it?
BTW the end result was withheld ajudication and is sealed.
