Modification of Custody: Changing Custody Due to the Health of the Custodial Parent

My question involves a child custody case from the State of: Michigan



I apologize if this seems insensitive. My boyfriend has a 14 year old daughter whom he has joint legal custody and visitation every other weekend. He has been a very cooperative parent, has never missed parenting time in 12 years, pays court ordered support and other out of pocket expenses. His ex has been hospitalized due to various health issues stemming from life long alcohol abuse. He was told that her condition is very serious and that she has a 50/50 chance of surviving. The daughter is currently staying in her mother's house with another relative (uncle) and refuses to stay with her father (various reasons - mainly having to do with rules).



As the joint legal custodian, can he get a court order to modify custody without having access to health records? Also, the ex's family is now refusing to give him any information regarding the mother's health condition. If she were not to survive, is there any way that he could obtain that information? As crazy as it sounds, I would expect her family to attempt fraud and continue to collect her child support and welfare.
