My question involves a relationship in the state of: Nevada
My friend has a car with his partner that has unpaid loan balance. They are breaking up. His partner is either a cosignor or co-applicant on the loan with my friend for this car. My friend does not know and his ex wont let him have access to their residence.
My friends partner has become rather unstable in the course of the break up and my friend wants an end to any ties with this person
The finance company/bank holds title
The car is registered in both their names.
My friend would like to take the car to a car buyer (dealership) and whatever the dealership will buy the car for, my friend will pay the difference to pay off the loan so the title will go directly to the dealer. The object is to end any contact/relationship with the ex partner as quickly and cleanly as possible.
Can my friend legally get rid of the car and the joint financial obligation without advising his ex? His ex has thrown my friends clothes out, turned off insurance, cell phones and is irrationally seeking to control and punish my friend so will not be interested in or cooperate with any decision so this needs to be a unilateral action.
The car is driven by my friend and my friend has made all the payments to date and the loan is current and in good standing. The car is currently in my friends possession.
