Civil Procedure Issues: [Small Claims] What Do I Need to Know for Filing

samedi 10 janvier 2015

My question involves court procedures for the state of: Washington

So I've been to this board before for advice and been extremely happy with the kind gentlemen (and -women) who have shared their time and experiences with me, so here I am again hoping a few of you are able to help me out.

The case is this: Less than a year ago, about eight months, I loaned an individual $500. This was, I was told, to help a friend of his with legal troubles (for bail, I believe). Story sounded off, and I wouldn't trust the individual in trouble, but the person asking for the loan I knew pretty well. He promised $600 back - an additional $100 for the trouble and immediacy (needed it by next day). I have this on record electronically, both phone text and Facebook messages.

He has yet to repay.

I have text and Facebook messages admitting he has not paid, after repeatedly saying he had dropped off money or "would later" and a considerable stream of other excuses.

I also have a security camera recording of the day he claimed to have dropped money off showing he never arrived (and later describing my house, so obviously having scoped it)

-but also admitting that he did in fact not come that day. (Security camera was Comcast Home Security. I have registration forms showing I have the security system in place and a video. Unsure if there is burden on proof to show it is from that exact day, but the file is time-stamped and as said, he admitted later to having not come.)

Now I have a few simple questions:

i. What is the procedure for going through this? I know I must go to the court in the city he lives in and file (Lynnwood, $30 I believe for administrative/court costs).

ii. Is there anything I should do / avoid doing?

iii. I would like to pretend that electronic messages alone, through two mediums, are proof enough but I know the law sometimes moves slower than technology.

iv. Should I make the amount $500 - representing what I gave - or $600, the promised amount back?

Thank you all for your time. Can't say I'm glad to be back asking for legal advice, but I'm glad I found a great community to come to.
