My question involves labor and employment law for the state of: Maine, Federal
I am a federal employee with a problem. This problem has a few facets:
1. I was injured (smoke inhalation) when a confined space filled up with smoke due to noncompliance with safety rules. I reported the violation to my supervisor before the injury, but I was scolded for having stopped work early to report it. I reported it again after the injury, including the actions of my supervisor.
2. I have developed a chronic breathing problem. I struggle to breath every day I am at work. I was treated in the ER as recently as 5 days ago.
3. I have limited duty restrictions from my doctor, including a prohibition on exposure to respiratory irritants.
4. Management is refusing to comply with my prohibition from being around respiratory irritants. They have suggested that it is an unreasonable restriction they are incapable of accommodating. They seem to be purposely giving me assignments that will aggravate my condition.
5. I have been subject to bullying, humiliation, disparaging remarks, and purposeful attempted exacerbation of my breathing problems by management.
6. My supervisors went behind my back and contacted my physician by phone and email. They made up an untrue story about me that seriously compromises my relationship with the doctor. They said they received specifics of my medical condition. They also said they tried unsuccessfully to have the doctor change my restrictions.
I'm truly exasperated at this point. I don't know how to proceed. It's a rock or a hard place. Please let me know of any recourse I may have.
