Co-Workers: Assaulted at Work. Person Not Terminated and I Feel Unsafe

vendredi 23 janvier 2015

My question involves labor and employment law for the state of: Louisiana

I was approached by a subordinate employee regarding a rumor. When I notified her that I was not interested in this sort of communication she became belligerent. Flailing her arms and referring to me using numerous vulgarities. when another employee intervened and tried to remove her from my space, she ran towards me multiple times and stated things like " ill be waiting for you after work, im going to kick your ass, and watch your back". once she was removed from the premises, the manager was notified and he contacted the police. because she lunged towards me and I felt threatened I was asked weather I wanted to file simple assault charges. Because I was under the impression that she would be terminated, I did not.

She was placed on suspension pending investigation and 2 days later added back to the schedule. I was not counseled or consulted regarding her return. I feel this is an unsafe work environment and I do not feel comfortable with her returning. I feel as if im in a situation where I will end up resigning my job out of fear.

My question is this: What are my options as far as resignation? Is this an unemployment case or where do I go from here?
