My question involves a lawsuit over unauthorized use of an image and defamation in federal court:
Does anyone have an opinion on the likelihood of this woman winning damages? What would she need to do to prove she had been defamed?
A woman from New Mexico named Veronica Vigil is suing Anne Taintor Inc. claiming the company obtained and used her high school graduation picture from 1970 on gift shop flasks without her permission. In addition, Ms. Vigil (who says she does not drink and has never used drugs) claims to have been defamed by Taintor's linking her image in a way that makes light of substance abuse. News link
