Eviction Process: Notice to Quit and Abandonment in New Jersey. a Question from a Tenant

My question involves an eviction in the state of: New Jersey



Hello All,



This is my first time posting on here, so be kind :)



I am a month to month tenant in a 2 family home in New Jersey, Union County. The landlord does not live on premises.



I travel often for business, and am often away from the property for extended periods of time. I spoke to the landlord on Dec 21 advising her of my intention to leave / give 30 days notice. She balked at first, but told me that I have to provide her with a 45 day notice as was stipulated on the month to month agreement. Today I get an email from her which was a Notice to Quit and Abandonment of my property, and that I had 3 days to get my stuff, or she would move it all into storage. The reason for Notice to Quit was a failure to pay rent. She is accurate in that I have not paid rent for the month of Jan/15. I had forgotten to, as I had been out of the country, and have been going through some serious personal issues (accident, death in the family, etc.) My personal issues should not really have come into the matter of rent payment, and I understand that, but I slipped up.



I replied to her, stating that it was my fault, that I had not paid, and that I intend to pay for Jan, as well as the late fees that accompany a late rent payment. I will have my property out by the end of Jan, and that she needn't put it in storage. Additionally, I told her that I have not and do not intend to abandon any of my personal property. She has not been picking up any of my phone calls.



My question is, can she still take my stuff out of the apartment and place it in storage after serving a Notice to Quit? I have everything there...my tv, jewellery, my clothes, kitchen utensils, cups, plates, laptops, monitors, socks, underwear.....I mean there is nothing there that says I am abandoning my stuff!!?? If it helps, the LL is a real estate agent.

edit: Additionally, there have been no prior notices, warnings, noise complaints or anything else for that matter in the past.
