I work for a company that is located in a business incubator facility. We have our own locking offices inside the facility.
My question involves US Postal Mail delivery:
To get mail service to our location, the postal carrier delivers all the mail for the business incubator's tenants in one mail tub to a central location inside the building. That is the extent of the USPS mail delivery. An employee of the business incubator then hand sorts the mail and puts it in a mail cubby to be picked up by the tenant. Packages that are too big to go into the cubby are left on the counter near the mail cubbies. The cubbies are not locked and the area where the cubbies are located is not monitored or secured in any way.
I ordered a package that was sent to the address at my place of work. The package was shipped 2nd Day Priority and came with a tracking number. The tracking information states the package was delivered on a certain date. The employee who sorted the mail said there was no package delivered.
What is the landlord's responsibility in keeping the mail secured so that someone is unable to just come in and walk off with someone else's package? And if the landlord has no responsibility to ensure delivery to the intended recipient then, is the mail carrier at fault for not properly delivering the mail?
