My question involves child support in the State of: Indiana
I am not court ordered to pay child support. We have joint custody and the father was ordered to pay me $25 a week when our child was 3. When our son entered school, the father became de facto custodian because we didn't live in the same school district. We have never gone back to court.
I have been voluntarily paying $150 a monthly for many years. The earliest I can find at this moment is 5/22/2009, but I know it started before then and can find old bank statements. Our son is now 18 as of 5/19/2014, graduated high school 6/2/2014 and has not been enrolled in secondary school and he is working a full time job. The father is asking me to continue to pay support. Should I just tell him no I don't have to, or should I file emancipation papers?
You do not have custody of your child(ren) and are ordered to pay support for the child(ren);
You have reason(s) to believe that at least one child for whom you are paying support to the same parent is emancipated;
You want the court to terminate your child support obligation; and
You and the other parent do not agree that your child support obligation should be terminated.
For purposes of child support, Indiana law (IC 31-16-6-6) considers a child emancipated if the child:
is age 19;
has joined the United States armed services;
is married;
is not under the care or control of either parent or someone else approved by the court; or
is at least 18 years old, has not gone to school for the last 4 months, is not enrolled in school, and is or is capable of supporting himself or herself through employment.
