Failure to Yield: Failure to Yield with Speeding Ticket

jeudi 22 janvier 2015

My question involves a traffic ticket from the state of: California

I got 2 tickets. One is for "Failure To Yield for Emergency Vehicle" and another one for Speeding 81 Miles per Hour (Limit is Miles Per Hour)

I was driving on a freeway between the speed limit 70 to 75 miles per hour.

Suddenly, I have seen a van behind me coming very close, it was little scary because i never seen this close any vehicle behind me before.

No Emergency light on the top the van.

No Siren Sound come from that vehicle.

At least, I was driving like this for 2 to 3 minutes. Then Suddenly, I had seen the emergency light come inside from the car behind my car, i said early, I did not see any light on the top of the vehicle. But the flash light come from the windshield of that car now. Immediately, I went to the shoulder and stopped the car.

Now i understood that this is police car. Police officer told to me, I was speeding up to 81 miles per hour and gave the ticket. He never talked about the "Failure to Yield for Emergency Vehicle" to me.

I have received the ticket from the court "Failure To Yield for Emergency Vehicle" and another one for Speeding 81 Miles per Hour (Limit is Miles Per Hour).

1, Yes, I was speeding more than 65 miles per hour but defiantly not more than 75 miles per hour.

2, Yes, It was possible that I have pushed my pedal upto 81 miles per hour because of the panic(I was seeing a car,. which is dangerously close). But i did not observed from the speedo meter.:grumpy:

3, No, I am not guilty on "Failure To Yield for Emergency Vehicle" because i never here a siren sound neither see any lights.

Now i am going to ask go for trial on both cases. Any Advice will be helpful.

Thanks,

Angeling
