My question involves defamation in the state of: Georgia where my daughter and her husband moved for his new job. They had all ready had trouble and only married less than a year. They returned back to Alabama for Christmas and had another fight before they were to leave and my wife drove back with them both to retrieve some of my daughter's personal belongings and one of the cars they had bought that was double the amount in debt. After returning back to Alabama he then refused to pay for the car and wanted it returned but the only way to return it was to take it back which we did and this took place within a couple days. We all returned and brought the car back and he was gone to his parents house and we entered the apartment with the key she had. Both names on the lease. We were mad to say the least and we let the air out of his work truck and the car but no damage should have been done and he admitted as much but we retrieved the rest of her things only and no damage inside the apartment. After we informed him that we had returned and removed her things and left the key to the apartment and car he started texting my daughter and then turned her phone off which was on his plan then he started texting my wife and he told her that he was going to file criminal charges against us all if she did not agree to his divorce agreement which of course was going to say my daughter had to pay for her car and her credit card which they had to charge the new cars to license them in GA. Now the car had been traded in twice on new cars and was double the amount it was worth and my daughter had given up a fairly good job here in Alabama to go with him so she has no money so she refused and he called the police and they could file no charges against us so he went to the local Magistrate the next work day and got a hearing for Criminal Trespassing on all of us including my daughter. He claimed he had people that seen us let the air out and that was a crime. Now I wonder first if any thing we did was actually a crime that could be punishable but, I want to know if the Judge finds no crime committed and does not charge us with anything, can we sue him for the cost of travel and loss of work and probably a hotel since it is over a 5 hour drive one way? The Judge seems to think we have no ability to get those expenses reimbursed even if there is no charges we are found guilty of but I wonder if we can force him to travel back into Alabama, since it would be hard to file damages against him in Georgia, to face defamation charges in Alabama?
