My question involves a child custody case from the State of: TN
I received a request for interrogatories and production of documents. Most of it is straight forward and most of it is about money, but I am hoping you can offer some guidance on a couple of the questions and I have a general question too... is something that likely wouldn't be admissible in court appropriate for discovery? Does including something in discovery make it admissible even if it can't be validated?
One question asks for proof of child care expenses... I pay the babysitter cash. Is just answering that I pay cash sufficient?
Asking for bank statements for 12 months. I do not want to give my ex or his lawyer my bank statements. Is there a way to avoid this?
One questions asks for a list of people who have "fact first hand" knowledge of any of the allegations made and what I believe them to know. Some of his allegations are things like that my son is severely neglected, not attending school, things like that... I assume this should be a complete list of anyone that can testify to my son's needs being met, or that he attends school.. should I include people that would testify on dad's behalf like grandma on this list?
Asks for EVERY reason child was removed from public school. This question is a little weird... my son is STILL in public school. Should I answer it as if it said removed from traditional local school? Or just respond not applicable because he is still in public school? There are MANY reasons... should I be vague here, or specific?
Asks to list every reason I was unable to get my son to school on time.... This is referring to kindergarten - one of their complaints about me is that he missed a lot of school in kindergarten (missed 18 days) I was not actually the person that took him to school every day, and all but a couple of those are because he was sick... one or two because I was too sick to drive him to school and one where I kept him out for a family activity. First, I'm wondering about how relevant it is since we're talking about last year (he has perfect attendance this year and straight A's this year) and it's actually one of the reasons to put on the above question about why I changed schools...
Lastly, the forms sent to me were altered after printing... the date on the original cover letter was 1/5 but it is hand written as 1/15 Just a 1 written in.. the notarized part says it was sent on the 9th, and I received it today... what is the actual deadline that I have to respond by?
