My question involves a child custody case from the State of: Virginia.
I am not sure if I am posting this in the correct forum.
I am married to a woman 18 years younger than me (I am 58). I am planning to retire this Spring, and I want to move to Colorado for both economic and lifestyle reasons (the outdoors, hiking, etc). I can live more cheaply out there on my pension and savings. Staying here on the East Coast might require me to continue to work, which I don't want to do.
My wife does not work. I am, and likely will continue to be, the sole source of support for our twins (age 12).
However, my wife does not want to move. There is no specific reason other than personal preference. No job or family is keeping her here.
So, am I stuck? Can she refuse to move, and refuse to allow me to take the kids, even though I am their (and her) sole support? I don't want to get into a divorce and custody battle, but I have been working for longer than she's been alive, and I am ready to move on to enjoy what time I have left in this life. She is not really an involved parent, and lets the kids do whatever they want. She takes no interest in their school work.
Thanks for any advice. Legal or otherwise.
