My question involves a consumer law issue in the State of: Pennsylvania
Greetings! My BF and I were were shopping for an engagement ring and we chose to visit a small locally owned store that specializes in antique and estate jewelery. We picked out an antique ring in store and inquired about a cash price vs layaway price and were told there was no difference if we paid cash in full or made payments. We decided to think about it over the weekend and concluded that we did want to purchase the ring. I contacted the store by phone and made arrangements for a layaway plan since we weren't in a rush to have the ring. The price of the ring was $6800 + tax with an additional charge of $25 for sizing the ring. A 20% deposit was required. I made a deposit of $2140 ($2000 plus tax) by credit card over the phone. I received an email with a scanned copy of my credit card receipt and a handwritten invoice for the layaway with a description of the ring. Payments were expected monthly and I was told we had up to 3 months to pay the ring off.
The following month I called the store to make the second payment on the ring and was told I would receive a call right back. After I waited about an hour I called the store again and was told by the owner that she couldn't find my ring and would not accept the payment at this time. She claimed that the ring had been sent out to be resized and now she couldn't find it. I said that I was confident it would turn up and I hoped to hear back from her with good news after a more thorough search had been conducted. I received a call back a few days later from the store owner stating that she still could not find the ring and that it was misplaced by the jeweler who was sizing it. She claims to be more upset than I am (shouldn't she have insurance for this sort of thing?) I am devastated and there is no way of replacing this antique ring. It's been a week since I last spoke with her. I suspect it may have been sold to another party (they have their inventory online as well) but I have no proof. Who sends a ring out to be sized when there is a balance owed? Do I have any rights besides getting my deposit back? Thank you for any help with this situation.
