My question involves a consumer law issue in the State of: NC. My fiancé and I were sold a used car from a dealership. We bought the car on 11/1/14. We were given the temporary tags that expired 12/1/14. The Saturday before it expired, we still had not received the permanent tag. The dealership reassured us that they would call us on Monday (the day the tags expired) and we never received a phone call. A few days later, I emailed the salesman. No reply. Went back to the dealership the next weekend. Again, he promised to call. Wrote down both of our numbers and my email address, promised to call first thing Monday morning. Never called or emailed. My fiancé called today, 1/15/25, as we still have no tags and the temporary ones are nearly 3 months old and are falling off the car. Asked for a manager. He texted my fiancé after looking into and said that the dealership still did not have the title from the previous owner of the car and that was why we couldn't get the tags.
How can a dealership sell a car without having the title. Isn't that proof of ownership? Technically the previous owner still owns the car, no? The previous owner refuses to sign the title, so the dealership can't get it. So, we cannot get our tags. Isn't this fraud, for a dealership to sell us a car when they do not own the car? I was told I am driving a stolen car.
I don't know how to deal with this situation. Any advice? We have made two $460 payments already.
