My question involves a consumer law issue in the State of: Michigan
Garage in question is a Tuffy Muffler franchise
Took car in to diagnose a leak.
Car is a 2007 Ford Fusion,, 124K, 3.0L AWD sedan
Was told the timing chain case was leaking.
Was given the option to just fix the leaking case, or replace the timing chain while they were in there.
Opted to replace the chain as well.
A couple of weeks went by and I felt I was getting the runaround from the garage.
Stopped by unannounced one evening after work to find that they were about 90% done installing a replacement engine in the car.
Mechanic sheepishly told me he was waiting for repair to be complete and car running before he was going to call and tell me.
Told me that the chain was installed incorrectly on my original engine, resulting in irreparable damage to my engine.
They procured a replacement engine without my knowledge or consent and put it in my car.
Replacement engine has 98,000 mile on it.
Timing chain came with the replacement engine on it, so timing chain has 98,000 miles on it as well.
Installation of engine is suppposed to be complete in the next couple of days.
Mechanic has stated (I have not agreed to anything) that I will only be billed for the new timing chain.
I feel that I am being wronged here. I took my car in expecting to leave with a new timing chain, and if I agree to what they want, I'll be leaving with a different engine, the provenance of which I have no idea, and a timing chain with 98000 miles on it for the ridiculous price of 1500.00
My thoughts are that I should be demanding to know more about where the replacement engine came from, and that I should be paying a pro-rated amount for a used timing chain. In my mind, the fact that they had to put a replacement engine into my car has nothing to do with it since they wrecked my original one.
I feel that the resale potential for my car has also been damaged due to the fact that the original engine is no longer with the vehicle.
NO WRITTEN QUOTES OR ESTIMATES WERE EVER PROVIDED...only a verbal quote on the phone and verbal authorization to replace the timing chain.
NOTHING WAS EVER SIGNED
Been doing business with them for a number of years and this is the first time I feel I've been treated dishonestly.
What recourse do I have here?
I want to be made whole, but feel that a lawsuit will get expensive fast...I'm fairly sure that if I go to small claims court, the franchise will show up with lawyers from tuffy, they will bump to district, and then all the legal feels will start adding up.
Any advice is greatly appreciated
