My question involves a repossession in the State of: TX
So, here is my situation.
1.- We operate a Used Car Business in Texas
2.- We purchased a Car at an Auto auction in Baton Rouge LA 18 months ago (I purchase at least 2 or 3 cars there every week).
3.- The Auctioneers gave me the title (Michigan), upon payment. It was signed by the previous owner, no legends of any liens on the title or elsewhere.
4.- I sell the vehicle at my lot and request the title transfer from the DMV.
5.- Texas Title is issued to my customer (transfer complete).
6.- 18 months after, vehicle is repossessed in Texas, turns out it had a lien in Michigan and in that state they give the owners the Title even if they owe money. The original seller took it to auction and sold it even though he still owed $17,000
Right now my client is without a car and asking for compensation.
Any advise is appreciated.
